1. Purpose and scope

These Terms and Conditions of Sale (“T&Cs of Sale”) govern the contractual relationship between Jérémy G (hereinafter “Shivim”) and any natural or legal person (hereinafter “the Customer”) who purchases a paid subscription or a sponsorship on shivim.ai.

Any purchase entails full and unreserved acceptance of these T&Cs of Sale as well as of the Terms of Use. The Customer acknowledges having read them before finalising the order.

2. Plans and pricing

2.1. Free plan

The Découverte plan is available with no commitment and without providing any means of payment. It includes:

  • 10 questions par jour (jusqu'à 13 après 17 h)
  • Access to the history of your conversations
  • Access to Ḥavrouta mode within the limit of the free allowance

Users who are not logged in are entitled to 3 questions par jour sans création de compte.

2.2. Paid plans

Two paid subscriptions are offered: Premium and Premium Plus. Each plan is available on a mensuel or annuel cycle; the annual cycle offers a discount of environ −17 % par rapport au mensuel.

The exact prices are displayed on the Premium page at the time of purchase, as well as on the payment page of our payment provider. The supported currencies are: EUR, USD, ILS. The currency is determined automatically based on your country of residence or your language preference. VAT not applicable, art. 293 B of the French General Tax Code (CGI) : the publisher benefits from the VAT-based exemption scheme as a micro-entrepreneur. The displayed prices are therefore net of VAT and no VAT will be collected or remitted.

2.3. Sponsorship

It is also possible to support Shivim through a one-shot sponsorship (single payment, with no subscription). The Customer may attach a public dedication, subject to our acceptance and to moderation.

3. Subscription

  1. The Customer selects a plan and a billing cycle from the Premium page.
  2. They are redirected to the secure payment page of our payment provider.
  3. They enter their payment details directly with that provider; no banking data passes through Shivim.
  4. Once the payment is validated, the Customer receives a confirmation email and their account is immediately credited with the subscription.

The contract is formed at the moment the payment is confirmed.

4. Payment

  • All payments are processed by a certified European payment provider that meets industry security standards (PCI-DSS).
  • Shivim never has access to your card numbers.
  • Accepted payment methods: bank cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, and SEPA transfer depending on availability in your country.
  • In the event of a failed charge, access to the paid features is suspended after a retry period defined by our payment provider.

5. Term and renewal

The subscription is entered into for the duration of the chosen cycle (one month or one year) and renews automatically at each expiry, unless the Customer terminates it before the renewal date.

In accordance with article L. 215-1 of the French Consumer Code, the Customer is informed that they may end the renewal at any time from the subscription management portal accessible via their My account area.

6. Free trial

A free trial of 7 days may be offered upon subscription to a Premium or Premium Plus plan. During this period:

  • The Customer enjoys the full set of features of the chosen plan.
  • No charge is made if termination occurs before the end of the trial.
  • At the end of the 7 days, the subscription is automatically renewed at the prevailing rate, unless terminated beforehand.
  • A reminder email is sent 48 hours before the first month is charged.

7. Right of withdrawal

The consumer Customer has a right of withdrawal of 14 days from the conclusion of the subscription contract, without having to give any reason for their decision (article L. 221-18 of the French Consumer Code).

Important. By subscribing to a plan and immediately accessing the paid features, the Customer expressly requests the immediate performance of the service before the end of the withdrawal period. Consequently, in accordance with article L. 221-25 of the French Consumer Code, the Customer waives their right of withdrawal for the portion of the service already provided as of the day of withdrawal. Any remaining balance remains due in proportion to actual use.

To exercise the right of withdrawal, write to support@shivim.ai stating your name, your account email and your intention to withdraw.

8. “Satisfaction guaranteed or your money back” guarantee

Independently of the right of withdrawal, Shivim offers a commercial guarantee of 30 days:

  • If you are not satisfied with your first Premium or Premium Plus month, write to us within 30 days of the purchase.
  • We will fully refund the amounts paid (excluding previous subscriptions).
  • The refund is made to the original means of payment within 5 to 10 business days.
  • This guarantee applies only to the first purchase, per account and per means of payment.
  • It does not apply in the event of manifest abusive use (creating multiple accounts to accumulate refunds, circumventing quotas).

9. Termination

9.1. By the Customer

The Customer may terminate their subscription at any time from their My account area (subscription management portal). Termination takes effect at the end of the current period already paid for; no pro rata is refunded except where the 30-day guarantee applies.

9.2. By Shivim

We reserve the right to terminate a subscription, with reasonable notice and a pro rata refund, in the event of:

  • serious and repeated breach of the Terms of Use;
  • fraud, identity theft or repeated non-payment;
  • permanent discontinuation of the service (minimum 30 days' notice by email).

10. Price changes

Prices may change to reflect changes in costs or in the offering. Any price increase is notified by email at least 30 days before it takes effect. The Customer may then terminate free of charge before the increase takes effect. Failing termination, the new price applies to the following cycle.

11. Invoicing

With each payment, an invoice is issued by our payment provider. You can view and download it from the subscription management portal accessible via your My account area. Invoices contain the mandatory legal information (company name, SIRET, the publisher's address, total amount) and bear the statement “VAT not applicable, art. 293 B of the French General Tax Code (CGI)”, the publisher being under the VAT-based exemption scheme.

12. Liability

Our liability in connection with the sale of subscriptions is limited to the amount actually paid by the Customer over the last 12 months, within the maximum limits permitted by law. The general exclusions set out in article 12 of the Terms of Use also apply to paying Customers.

13. Personal data

The data collected in connection with payments (billing email and subscription status) is processed in accordance with our Privacy Policy. Our payment provider acts as a processor for the processing of payment data.

14. Governing law and dispute resolution

These T&Cs of Sale are governed by French law. Any dispute relating to their interpretation or performance shall, failing amicable resolution, fall within the jurisdiction of the courts of the place of the registered office of Jérémy G, subject to the public-policy rules protecting the consumer.

After a prior written complaint that has remained unsuccessful, the consumer Customer may have free recourse to a consumer mediator (art. L. 612-1 et seq. of the French Consumer Code). The Customer may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
